Terms of Use

These Terms govern your use of the Lucas Baby Pediatrician Portal ("the Portal"). By creating an account or signing in, you agree to be bound by them.

1. What the Portal is

The Portal is a clinical monitoring aid. It displays patient-reported data (entered by parents in the Lucas Baby iOS app) and lets you annotate it, log visits, prescribe medications for your own records, and upload documents. It is not a medical device, not a certified EHR, and not the system of record for any patient.

The Portal software, design, and trademarks belong to the operator. You are granted a limited, non-transferable license to use the Portal for your clinical practice.

Clinical notes you author remain attributable to you. Parents retain ownership of their baby’s records.

6. Availability and changes

The Portal is provided on an "as available" basis. We aim for high uptime but do not guarantee uninterrupted service. We may change or discontinue features on reasonable notice.

7. Termination

You can delete your account at any time from account settings. We may suspend or terminate accounts that violate these Terms, with written notice where feasible. On termination, your access to patient data ends immediately.

8. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE PORTAL IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND — EXPRESS, IMPLIED, OR STATUTORY — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of liability

To the extent permitted by law, the operator’s total aggregate liability arising from or related to the Portal is limited to the fees you have paid to us in the 12 months preceding the claim (or, if the Portal is free to you, USD $100). Neither party is liable for indirect, incidental, or consequential damages.

10. Indemnity

You agree to defend and hold harmless the operator from third-party claims arising out of your clinical decisions, your breach of these Terms, or your misuse of patient data.

11. Governing law and disputes

These Terms are governed by the laws of the operator’s principal place of business, without regard to conflict-of-laws rules. Disputes that cannot be resolved informally will be resolved in the courts of that jurisdiction.

12. Changes to these Terms

We may revise these Terms. We will post the updated effective date and, for material changes, notify you by email at least 14 days before they take effect. Continued use after changes take effect means you accept them.
